Restore usurped check of one government branch over other

NASHVILLE, April 20, 2019 — The system of checks and balances in our government was developed to ensure that no one branch of government would become too powerful.

Our corrupt judiciary controlled by and/or in concert with the BAR, has de facto usurped the power of removal and impeachment of bad actor judges, by taking control of key positions in our legislative houses, and by enacting unconstitutional judicial oversight agencies.

The undeniable fact that the Tenn. Board of Judicial Conduct has never once recommended impeachment or removal in the last sixty years, and the further fact that there has not been a single impeachment since 1958 in the state of Tennessee, is prima facia evidence of this usurpation of legislative power and the balance of checks of one branch over the other.

In the words of Thomas Jefferson:

The judiciary; an irresponsible body, working like gravity by night and by day, gaining a little to-day & a little tomorrow, and advancing it’s noiseless step like a thief, over the field of jurisdiction, …, it will render powerless the checks provided of one government on another, and will become as venal and oppressive as the government from which we separated.

Petition being ignored

The dire circumstance we find ourselves in today surely evidences a government as “venal and oppressive as the government from which we separated.” The fact my Petition of Remonstrance remains ignored while including complaints against bad actor judges, further evidences control of these houses by the judiciary and/or BAR. If we do not reverse this usurpation of power, our republic will surely fall into ruin and eventually collapse.

I respectfully ask the members of the 111th Congressional Session & General Assembly to show courage and stand with me, and re-institute the separation of powers and checks and balances provided for in our state constitution.

Do so, and this state, this nation, will know a rebirth of liberty and justice unparalleled since our Declaration of Independence. Your oaths demand this of you, the people demand this of you, and I demand this of you.
